Welcome to the first ACCC Consumer Data Right newsletter.

There have been a number of significant developments over the last few months, including the release of draft legislation and the development of a Rules Framework related to the implementation of Open Banking.

ACCC consultation on the Rules Framework

The ACCC will be releasing a Rules Framework in the week commencing 10 September 2018. The framework is intended to give stakeholders an understanding of the structure and content of proposed rules that will underpin the implementation of Open Banking, including a phased approach to implementation. It sets out how the ACCC proposes to address particular issues in the CDR Rules and seeks feedback on these proposals. Feedback on the Rules Framework will be open for approximately one month. The ACCC will be holding consultation roundtables on the following dates:

  • 24 September—Melbourne
  • 25 September—Sydney
  • 9 October—online consultation via webinar

More information, including the Rules Framework and details on how to register for a consultation roundtable, will be published at Consumer Data Right over the coming weeks.

Treasury consultation on the enabling legislation

Treasury has opened consultation on the Treasury Laws Amendment (Consumer Data Right) Bill 2018. Submissions will be accepted until 5 pm Friday 7 September 2018. The draft Bill and explanatory documents are available via the Treasury website and responses to the consultation will inform Regulation Impact Statement and Privacy Impact Assessment processes.

Treasury will be conducting a number of two-hour roundtables on the following dates:

  • 23 August 2018—Melbourne
  • 28 August 2018—Sydney
  • Other capital cities will be considered upon receipt of expressions of interest

If you wish to attend a roundtable, please email data@treasury.gov.au indicating your preferred location and if there are any times on that day you will not be able to attend by 12 pm AEST on 20 August 2018.

Technical standards

Data61 as the Data Standards Body has begun its ongoing public engagement on technical standards for the Consumer Data Right and Open Banking. A website will be coming soon, along with information about work underway on information security, API standards and consumer user experience. The API standards working group is already underway.
